Terms of Service

1. Acceptance

By creating an account or using WildComiks ("the Service"), you agree to these Terms. If you do not agree, do not use the Service. These Terms apply to all users, including visitors, free-tier users, and paid subscribers.

2. Your IP — You Own It

Any comic, character, story, or artwork you create using the Service is yours. WildComiks claims no ownership over your creative output. You retain all copyright to the content you produce, subject only to the content restrictions in Section 5.

You grant WildComiks a limited, non-exclusive, royalty-free license solely to operate the platform — for example, to display your work to you in your dashboard, or to process images through generation pipelines. We do not use your output to train AI models without your explicit opt-in consent.

3. Accounts & Access

• You must be 13 years or older to use the Service (18+ for certain content tiers).
• You are responsible for all activity under your account.
• Keep your credentials secure. Notify us immediately at legal@wildcomiks.com if you suspect unauthorized access.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions & Billing

Paid plans are billed on a recurring basis (monthly or annually) via Stripe. You may cancel at any time; cancellation takes effect at the end of your current billing period. No partial refunds are issued for unused time unless required by law. Credit packs (purchased generation credits) are non-refundable once consumed.

We may change pricing with 30 days' notice. Continued use after the effective date constitutes acceptance of the new pricing.

5. Acceptable Use

You agree not to use the Service to generate or distribute:

• Content that sexualizes minors (CSAM) — strictly prohibited, immediately reported to NCMEC.
• Non-consensual intimate imagery (NCII).
• Content that constitutes targeted harassment, threats, or incitement to violence.
• Deepfakes of real people designed to deceive.
• Content that infringes third-party copyright or trademark.
• Malware, phishing material, or anything designed to harm others' systems.

Violations may result in immediate account termination and referral to law enforcement where applicable.

6. AI-Generated Content Notice

Output from the Service is generated by AI models. Results may be unexpected, imperfect, or inconsistent. WildComiks makes no warranty that generated images are original, free of third-party IP, or suitable for any particular commercial use. It is your responsibility to review output before publishing or commercializing it.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WILDCOMIKS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WILDCOMIKS' TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $50 USD. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

9. Changes to These Terms

We may update these Terms. We will notify you via email or an in-app notice at least 14 days before material changes take effect. Continued use after the effective date means you accept the updated Terms.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law provisions. Disputes shall be resolved by binding arbitration under AAA rules, except either party may seek injunctive relief in a court of competent jurisdiction.
